O'Connor v. Raymark Industries, Inc.

518 N.E.2d 510 (Cite as: 401 Mass. 586, 518 N.E.2d 510)

Supreme Judicial Court of Massachusetts, Middlesex.

Ann O'CONNOR, executrix, [FN1]

FN1. Of the estate of Richard O'Connor.

v.

RAYMARK INDUSTRIES, INC.

Argued Oct. 7, 1987.

Decided Jan. 25, 1988.

Worker who had been exposed to asbestos on job brought action for personal injuries and his wife brought action for loss of consortium against asbestos manufacturer. During pendency of the action, worker died from asbestos related disease and widow was added as executrix and claim for wrongful death was added. The Superior Court, Middlesex County, James P. Lynch, Jr., J., entered judgment on jury verdict in favor of asbestos manufacturer, and executrix appealed. The Supreme Judicial Court, O'Connor, 1., held that trial court's instruction on causation was adequate.

Affirmed.

Leonard F. Zandrow, Jr. (Thomas P. O'Reilly, Richard L. Neumeier and Janet L. Maloof, Boston, with him), for defendant.
