Advest, Inc. v. McCarthy
914 F.2d 6
C.A.1 (Mass.),1990.
Brokerage house moved to vacate arbitral award ordering restoration of shares of investor's stock that had been wrongfully liquidated. The United States District Court for the District of Massachusetts, Walter Jay Skinner, J., denied motion. On appeal, the Court of Appeals, Selya, Circuit Judge, held that brokerage house failed to show that arbitrators manifestly disregarded law when they ordered restoration as part of remedy for wrongful liquidation of investor's holdings.
Affirmed.
Leonard F. Zandrow, Jr., with whom Richard L. Neumeier, Vincent M. Amaroso, B. Deidre Brennan, and Parker, Coulter, Daley & White, Boston, Mass., were on brief for defendant, appellee.
