In re Robert J. MATTHEWS'S (dependent's) Case.

Argued Dec. 12, 1988.

Decided Feb. 17, 1989.

Further Appellate Review Denied March 28, 1989.

The Industrial Accident Reviewing Board determined that statute, which provided for calculation of workers' compensation benefits based on rate in effect on date of final decision, rather than on date of injury, did not apply to claim filed by employee's widow. Widow appealed. The Court of Appeals, Suffolk County, Brown, J., held that statute did not apply to widow's claim.

Affirmed.
